confiscation of newspaper in Azerbaijan.

Police Confiscate Newspaper Posted on

CASCFEN-On Sunday, April 20, 2003
policemen in Nizami District of Baku, Azerbaijan
confiscated copies of the newspaper "Bizim Yol"
(Our Way) from the retailers. As told one of the
sellers on day time of Sunday policemen in the
territory of Nizami District begun to stop
newspaper sellers and convene them to police
station.

Cartoon in Azeri paper leads to arrest of news
vendors. Text of Tale Asad report by Azerbaijani
newspaper Yeni Musavat on 18 April entitled
"Police acts as censor"
Several vendors of Bizim Yol newspaper were
arrested near the Neftcilar underground station
by employees of the Nizami district police
department [of Baku] yesterday [17 April]. In
this connection, we telephoned the police
department. The duty officer answering the
phone confirmed the
arrest, saying that it was connected with the
"Bizim Kuklalar" [Our Dolls] cartoon published
on the newspaper's back page.
To clarify the situation, we called the general
secretary of the Azerbaijani Confederation of
Journalists, Azar Hasrat. He said he was aware
of what had happened: "The police have no right
to confiscate newspapers or arrest those selling
them. This is, of course, arbitrariness. Only if
there is a
court verdict can the police confiscate a
newspaper. If someone doesn't like a cartoon
or an article in a newspaper, they should apply
either to the Press Council or to the court. Those
guilty of such arbitrariness must be punished.

Cartoonists Rights Network condemns the
confiscation of newspapers, and the detention
of legitimate news vendors simply going about
their business. Acts like these brings into
question the Azerbaijani Government's
intentions with journalists and its unconvincing
commitment to freedom of expression.

Some four sellers were stopped and convened
to the police station where they were questioned
about the newspaper "Bizim Yol." Police asked
sellers where did they get copies of the paper,
who is behind that etc. Then the copies of "Bizim
Yol" were confiscated and sellers set free. No
violent behavior was observed during this
"clearance"action.
Newspaper's editor-in-chief Muhammed Arsoy
told to CASCFEN that the case was connected
to the cartoon of the president Heydar Aliyev
which was published on the last issue. The
cartoon describes Aliyev sitting on donkey and
his son, Ilham keeping the tail of the donkey
and crying: "Dad, take me too..." But father
says: "Your English is not pure. As soon as you
learn to speak pure English I'll take you with
me".

Arsoy said that the authorities are feared of the
growing popularity of the newly appeared
weekly and "we're waiting other acts of the
violation of our rights".
Later on Monday, April 21, the confiscation or
restriction of distribution of the newspaper
continued in other parts of the city.
CASCFEN Council Chairman Azer H. Hasret
condemned the fact and called on authorities
to end with the violation of rights of free media.
"In case of continuance of such kind of
behaviors we'll show our solidarity and take
actions to protect our colleagues," added
Hasret.
"Bizim Yol" is newly appeared independent
weekly very critical to President Heydar Aliyev.

Editor Ali Lmrabet in Jail Because of a Cartoonist's Work

Editor Ali Lmrabet sentenced to four years
in prison Reporters Without Borders voiced
dismay over the jailing today of newspaper
editor Ali Lmrabet immediately after a
court convicted him of "insulting the king,"
sentenced him to four years in prison and
a fine of 20,000 dirhams (about 2,000
euros) and banned his two weeklies, Demain
Magazine and Douman. Lmrabet has been
on hunger strike since 6 May.
"We are dismayed and horrified by this
verdict," Reporters Without Borders
secretary-general Robert Ménard said,
calling for Lmrabet's immediate and
unconditional release. "The Moroccan
justice system has once again proved its
incapacity to act with independence."

Lmrabet was about to fly from Rabat
airport to Paris on 17 April, two agents from
the Directorate of Territorial Surveillance
(DST) told him he was banned from leaving
the country "on the instructions of the
DST." The ban was lifted the following
week.
Previously, at the beginning of May, the
owner of the printing works Ecoprint told
Lmrabet that he would have to stop printing
Lmrabet's two weeklies because of
pressure being put on him. He later said it
was because he disagreed with their
content.
When he began his hunger strike on 6 May,
Lmrabet said he was acting to defend his
rights, to stop repeated acts of
intimidation against his printer and others
who would otherwise be ready to print his
weeklies, and in order to be able to enjoy
the right to freedom of movement. As

imprisoned journalists and press freedom
throughout the world, as well as the right
to inform the public and to be informed, in
accordance with Article 19 of the Universal
Declaration of Human Rights. Reporters

that article 400 of the criminal code, which
permits a defendant's immediate arrest,
has been applied in the case of a press
offence. "Is Ali Lmrabet a dangerous
criminal who must be imprisoned on the spot
?" he asked. Ménard said the four-year jail
sentence posed "a clear threat to the rest
of the independent press."
At a time when Morocco was having to deal
with tragedy, Reporters Without Borders
said it called on King Mohammed VI to act
boldly to demonstrate his commitment to
real press freedom without taboos and nogo zones, a freedom that was seriously
undermined by today's verdict.
Background Lmrabet's trial on charges of
"insulting the person of the king", "offence
against territorial integrity" and "offence
against the monarchy" began on 13 May. He
was prosecuted for articles and cartoons
about the annual allowance that parliament
grants the royal family (detailed in a
finance ministry document distributed to
parliamentarians), the history of slavery,
a photomontage of Moroccan political
personalities, and an interview with a
Moroccan republican who advocated selfdetermination for Western Sahara.
The king's prosecutor initially requested
the maximum five-year prison sentence, a
fine of 100,000 dirhams (about 10,000
