INR 121 Fundamental Concepts of Law

Introduction: This course examines the basic concepts of law and the preliminary issues in
Turkish legal system. We will look at the basics of the institutional and the organisational
structure through which the market-based allocation of resources is guaranteed. The main
concern of the course will be the answer of the question of how positive law works rather than
the answers to the questions concerning the impact of law on the ‘distribution of wealth’ and the
raison d'etre of certain rules. However, some clues for the introduction to the sociology of law
will also be given to the interested students.
Scope: An introductory answer to the question of how positive law works in Turkey requires an
examination on such issues (the books referenced in brackets are the required material):

Sources of Turkish Law (Ansay and Wallace, 1996:1-18);

The Principle of the Rule of Law (Fine, 1986:169-189)
Attendance: Attendance is subject to the university rules.
Evaluation: There will be one mid-term (%40) and a final (%60) exam.
