PEPE Çevre ve Orman Bakanı Türkiye Cumhuriyeti Genelkurmay Başkanlığı ve İtalya Cumhuriyeti Milli Savunma Bakanlığı Arasında Türk Hava Kuvvetleri Tarafından İtalya Cumhuriyeti Hava Kuvvetlerine Mensup Personele F-16 Uçaklarında Verilecek Uçuş Eğitimlerine İlişkin Protokol GİRİŞ Türkiye Cumhuriyeti Hükümeti ile İtalya Cumhuriyeti Hükümeti (Bundan sonra Taraflar olarak belirtilecektir); 4 Nisan 1949 tarihli Kuzey Atlantik Antlaşmasının 3 üncü Maddesinde yer alan eğitim amaçlarına katkıda bulunmak üzere; 10 Haziran 1951 tarihli (NATO SOFA) Kuzey Atlantik Antlaşmasının Kuvvetlerin Statüsü Anlaşmasının Gönderen Devlet personelinin statüsünü belirleyeceğini, Mevcut ve devam eden dostluklarından hareketle Türk Hava Kuvvetleri tarafından İtalya Hava Kuvvetleri Komutanlığına mensup personele, Türkiye'de F-16 uçakları ile verilecek uçuş eğitiminin aralarındaki mevcut iyi ilişkilere sağlayacağı katkının önemini göz önünde tutarak, Bu eğitimin esaslarını belirlemek üzere aşağıdaki hususlarda mutabakata varmışlardır. BÖLÜM I AMAÇ İşbu protokolün amacı, Türk Hava Kuvvetleri tarafından İtalya Hava Kuvvetleri Komutanlığına mensup personele, Türkiye'de verilecek F-16 uçuş eğitiminin esaslarını ve sorumluluklarını belirlemektir. BÖLÜM II KAPSAM İşbu protokol; Türkiye Cumhuriyeti Hava Kuvvetleri Komutanlığının ilgili eğitim birimleri ile İtalya Hava Kuvvetleri Komutanlığını ve Türkiye'de eğitim görecek İtalya Hava Kuvvetleri Komutanlığına mensup askeri personeli kapsamaktadır. BÖLÜM III TANIMLAR İşbu protokolün amacı için, müteakip tanımlar, aşağıda kararlaştırılan anlamlara haiz olacaktır. 1. "Gönderen Devlet (GD)" terimi; eğitim alan askeri personelin mensup olduğu devleti ifade eder. 2. "Kabul Eden Devlet (KED)" terimi; askeri personeli eğitim amacıyla ülkesinde bulunduran devleti ifade eder. 3. "Misafir Askeri Personel (MAP)" terimi; Gönderen Devletin silahlı kuvvetlerine mensup olup, Kabul Eden Devletin eğitim kurumlarında eğitim gören askeri personeli (Subay/Astsubayı) ifade eder. 4. "Yakınlar" terimi; Misafir Askeri Personel (MAP)'in kendi ülkesinin mevzuatına göre bakmakla yükümlü olduğu eş ve çocuklarını ifade eder. BÖLÜM IV SORUMLULUKLAR VE EĞİTİMLERE İLİŞKİN ESASLAR 1. Kabul Eden Devletin Sorumlulukları: a. KED Hava Kuvvetleri, MAP'a işbu protokolde yer alan hükümler çerçevesinde ve mevcut imkanlar dahilinde, protokolde adı geçen eğitim ve kursların ücreti karşılığında verilmesini sağlayacaktır. b. Verilecek olan eğitim ve kurslar Üçüncü Maddede belirtilmiştir. 2. Gönderen Devletin Sorumlulukları: a. GD, MAP'ın eğitimin gerektirdiği (Dördüncü Maddede belirtilen) hazır bulunuşluluk seviyesinde seçilip bildirilmesinden sorumludur. KED bu hususu kontrol edici tedbirleri alacaktır. b. GD, her bir MAP için daha önce kalıcı bir hastalık geçirmediği, halihazırda virüs (HİV, HEPATİT, vb.) taşımadığı, uçuşa engel olabilecek bir rahatsızlığının olmadığına dair tam teşekküllü bir hastaneden alınacak onaylı bir belgeyi MAP Türkiye'ye gelmeden önce KED makamlarına gönderecektir. Ayrıca, MAP Türkiye'ye geldikten sonra KED tarafından belirlenecek tam teşekküllü bir hastaneden de yukarıda belirtilen hususlarla ilgili sağlık raporu alınacaktır. Türkiye'den alınacak raporlarda uçuşa engel bir rahatsızlığının belirlenmesi durumunda, MAP ülkesine geri gönderilecektir. c. MAP'ın KED'e varış ve ayrılışı ile KED sınırları dahilindeki bütün ulaşım masrafları GD tarafından karşılanacaktır. 3. GD Personeline Verilecek Eğitim ve Kurslar: a. Uçucu Sağlık Muayenesi ve G-LAB Eğitimi. b. F-16 Yer Dersleri (Filo ve Teknik Eğitim Merkezinde). c. F-16 Simülatör Eğitimi. d. F-16 BLOCK 30/40 uçaklarında F-16 uçuş eğitimi (23.00 saat/18 sorti). e. GD tarafından talep edildiği takdirde ilave kurs ve eğitimler düzenlenecek ilave Teknik Düzenlemeler ile ücreti karşılığı KED tarafından verilecektir. 4. Eğitime Katılacak Personelde Bulunması Gereken Nitelikler: a. İngilizce lisan seviyesi 85 ECL olmak (İngilizce Lisan Seviye Tespit Sınavı, KED tarafından Türkiye'de yapılacaktır.) b. Pilotaj muayenesi neticesi "Pilotaja Elverişli" olmak (Uçuş muayenesi, ücreti karşılığında, KED tarafından Türkiye'de yapılacaktır.) c. F-16 Uçuş Eğitim programı için kriterler; (1) Pilot hatası nedeniyle hiçbir kırımı olmamak, (2) Asgari üç yıllık kıt'a uçucusu (Harbe Hazır) olmak veya 500 saat muharip jet uçuşunu tamamlamış olmak, (3) Türkiye'de eğitime başlama tarihinden önce, uçuşa 90 günden fazla ara vermemiş olmak. d. MAP, NATO'nun Gizlilik dereceli dokümanlarına nüfuz edebilmesi için gerekli NATO Gizlilik Kleransı Belgesine sahip olacaktır. MAP, göreve başladığında bu belgeyi KED makamlarına göstermek zorundadır. e. Yukarıdaki maddelerde belirtilen eğitime katılacak personelde bulunması gereken niteliklere sahip olmadığı tespit edilen MAP eğitime başlatılmadan ülkesine geri gönderilecektir. 5. Eğitim Esasları: a. KED bu protokole konu eğitimleri, kendi ulusal kanun, tüzük, yönetmelik, yönerge, emir ve eğitim programları kapsamında verecektir. b. Eğitimler İngilizce dilinde icra edilecektir. 2 c. Eğitim görecek MAP, hiçbir koşulda eğitimini aksatmayacak, birlik için uygulanan çalışma saatlerine ve takvimine uyacaktır. 6. Eğitim Süreleri: a. Uçucu Sağlık Muayenesi ve G-LAB Eğitimi 3 iş günü sürelidir. b. F-16 Uçak Teknik Eğitimi 10 iş günü sürelidir. c. F-16 Filo Yer Dersleri 144 saat sürelidir. d. F-16 Simülatör Eğitimi 12 saat/9 sortidir. e. Bu eğitimin (23.00 saat /18 sorti) toplam süresi 69 iş günüdür. f. KED, GD ile koordineli olarak yukarıda belirtilen uçuş saat ve sortilerinde ihtiyaca göre değişiklik yapma hakkına sahiptir. 7. Eğitim Ücretleri: a. KED tarafından verilecek eğitim ve kurslara ait ücretler EK-A'da yer almaktadır. b. KED, eğitimin sona erdiği tarihe uygun olarak iki nüsha orijinal fatura düzenleyecek ve GD'nin yetkili makamlarına iletecektir. c. GD tarafından, fatura tutarı, Milli Savunma Bakanlığının T.C. Merkez Bankası Ankara Şubesi 85-859-001-021 No.'lu döviz hesabına ABD Doları olarak yatırılacak, yatırıldı belgesinin bir nüshası KED Hv.K.K.lığına gönderilecektir. d. Roma'da bulunan Türk Askeri Ataşeliği vasıtasıyla GD'ye iletildiği tarihten itibaren 90 gün içerisinde ödenmeyen faturalara, KED tarafından ABD Doları cinsinden aylık gecikme faizi uygulanacaktır. Gecikme faizi, ödeme tarihinde İtalya'da geçerli olan yıllık faiz oranına göre hesaplanacaktır. e. MAP'ın herhangi bir sebeple eğitim programını tamamlayamaması durumunda, GD sadece verilmiş olan eğitimin ücretini ödeyecektir. f. Taraflarca üzerinde mutabık kalınan eğitim programları haricinde ihtiyaç duyulabilecek ve programa dahil edilebilecek ilave eğitim ihtiyaçlarının (sentetik, akademik, uçuş, sağlık muayenesi vb.) ücretleri ayrıca hesaplanarak tahsil edilecektir. Elverişsiz meteorolojik koşullar, emercensi durumlar ve KED'in Üs Komutanı emri ile geçersiz olan sortiler için ücret talep edilmez. 8. Eğitime Son Verme Şartları: MAP'ın; sağlık problemi nedeniyle eğitimi takip edememesi, verilen eğitimdeki başarısızlığı ve disiplinsizlik halleri KED'in kanun, tüzük, yönetmelik, yönerge vb. kapsamında değerlendirilerek gerekli görülmesi durumunda MAP'ın eğitimine son verilerek ülkesine geri gönderilecektir. BÖLÜM V SAĞLIK HİZMETLERİ 1. MAP ile bakmakla yükümlü oldukları yakınları askeri/sivil sağlık kurum ve kuruluşlarının hizmetlerinden (muayene, tedavi, tahlil, ilaç vb.) ücreti karşılığında faydalanır. 2. Acil durumlarda ilk müdahale ve ambulans ile en yakın sivil/askeri sağlık kuruluşuna ulaştırma konusunda herhangi bir ücret talep edilmez. 3. Sağlık problemini beyan eden MAP, askeri sağlık kurum ve kuruluşlarında muayene ve tedavi olmak istiyor ise, birliği tarafından askeri sağlık kurum ve kuruluşlarına sevk edilir. Askeri sağlık kurum ve kuruluşlarında MAP ve yakınları için yapılan muayene, tedavi, tahlil, ilaç vb. masrafları GD Askeri Ataşeliği/Büyükelçiliği tarafından BÖLÜM IV 7c fıkrasında yer alan Milli Savunma Bakanlığının T.C. Merkez Bankası hesabına yatırılır. 4. MAP, KED uçucu personeline uygulanan tüm periyodik sağlık kontrollerinden ücreti karşılığı geçecektir. 5. MAP ya da bir yakınının, görev esnasında ya da görev harici KED sınırları dahilinde vefatı durumunda, KED durumu en kısa sürede GD makamlarına bildirecek, GD vefat eden şahsın cenaze işlemlerinin KED sınırları dahilinde yapılarak gömülmesine ya da GD'ye uçakla gönderilmesine karar verecektir. BÖLÜM VI GÜMRÜK USULLERİ 1. MAP, KED ülkesine giriş/çıkışta ve bu ülkede bulunduğu süre içinde KED gümrük mevzuatına tabi olacaktır. 2. MAP, diplomatik pasaport taşımayacak, yabancıların KED ülkesinde ikamet ve seyahatleri hakkındaki kanun hükümlerine tabi olacaktır. İkamet izni ve benzeri harçlar GD ya da MAP tarafından karşılanacaktır. BÖLÜM VII 3 İDARİ ESASLAR 1. KED, üçer aylık dönemler halinde MAP'ların disiplin, eğitim, sağlık vb. durumu konularını içeren bir rapor hazırlayarak GD yetkili makamlarına iletecektir. Ayrıca, ihtiyaç duyulması halinde dönüşümlü olarak Türkiye'de ve İtalya'da yılda birer defa PMR (Program Management Review) toplantıları icra edilecektir. 2. KED, MAP ile ilgili uçuş kayıtlarını ayrı bir dosya halinde tutacaktır. Eğitimlerin tamamlanmasını takiben KED, MAP ile ilgili tüm kayıtları (uçuş, doktor muayene, disiplin vb.) eğitim sonucunda ulaştığı seviyeyi ve aldığı eğitimlerle ilgili ölçülebilir sonuçları "Sonuç Değerlendirme Raporu" ile GD yetkili makamlarına iletecektir. 3. İhtiyaç duyulması halinde, GD tarafından, MAP'ın özlük hakları ve diğer idari işlemlerinin takibi için Türkiye'de bir İrtibat Subayı görevlendirilebilir. İrtibat Subayı görevlendirmesi yapılmadığı durumda bu görev MAP arasındaki en kıdemli personel tarafından yürütülecektir. 4. MAP'a, eğitim görmekte olduğu Birlik Komutanlığı tarafından Misafir Askeri Personel Kimlik Kartı verilecektir. MAP, kimlik kartını yanında taşımaya mecburdur. MAP'a verilen kimlik kartı, ülkesine dönmeden önce, ayrılış işlemlerini yapan Komutanlık tarafından geri alınacaktır. 5. MAP, eğitimde bulunduğu sürece, KED personeline uygulanan disipline ilişkin tüm kanun, yönetmelik ve komutanlık emirlerine uymakla yükümlüdür. Disiplin işlemleri konusunda aşağıdaki hükümler uygulanacaktır. a. KED yetkili makamları, MAP'a disiplin cezası verme yetkisine sahip değildir. MAP'ın görevle ilgili olan ya da olmayan disiplin ihlalleri yazılı olarak GD yetkili makamlarına bildirilecektir. b. MAP, KED askeri personeli üzerinde Disiplin Amirliği uygulama yetkisine sahip değildir. Ancak, görevle ilgili konularda emrindeki personele görevin gerektirdiği emirleri verebilecektir. 6. MAP, KED sınırları içerisinde özel araç edinebilir ve kullanabilir. KED personeline uygulanan tüm trafik kurallarına ve mevcut mevzuata aynı şekilde uymakla yükümlüdürler. 7. Verilecek kurs ve eğitimlerde MAP'ın tatil ve izin durumları, KED resmi ve dini bayramlarına göre organize edilecektir. Ancak, GD tarafından uygulanan resmi ve dini bayram/tatil günlerinin önceden bildirilmesi kaydıyla, bu tarihlerde MAP'a izin verilebilecektir. 8. Malî Hususlar: GD eğitimin devamı süresince MAP ile ilgili aşağıda sıralanan harcamaları karşılamakla sorumludur: a. Bu protokol maddelerinde açık olarak adı geçen ve KED tarafından sağlanacak olan eğitim, sağlık, giyim-kuşam vb. hizmetlere ait ücretler, b. MAP'ın maaş, yolluk ve yevmiyeleri, c. MAP'ın bakmakla yükümlü olduğu bireylerin ve bunlara ait eşyaların KED'e gelişinde ve ayrılışındaki transfer harcamaları ile KED sınırları dahilindeki her türlü ulaşım harcamaları, d. MAP'ın, bakmakla yükümlü olduğu bireylerin vefatı halinde cenazelerinin ülkelerine nakli ve cenaze masrafları, e. MAP'ın GD adına gerçekleştireceği görevlere ait harcamalar, f. MAP'ın ve bakmakla yükümlü olduğu bireylerin KED sınırları içinde ya da dışında gerçekleştireceği seyahatler ile ilgili harcamaları. 9. Giyim-Kuşam: a. Uçuş eğitimi ve kurslar için ihtiyaç duyulan yazlık ve kışlık uçuş kombinezonu, uçuş ceketi, uçuş botu, eldiven ve diğer tüm teçhizat GD tarafından sağlanacaktır. b. GD'in talep etmesi durumunda uçuş teçhizatı ücreti mukabilinde KED tarafından temin edilecektir. MAP'ın kıyafetlerinde standardizasyon, GD tarafından sağlanacaktır. c. MAP, KED tarafından verilecek bir askeri sembolü, tanınma amacıyla uçuş kombinezonuna ve üniformasına takacaktır. d. MAP, eğitim safhasında ve KED kurumları içerisinde kendi ulusal üniformasını giyecektir. Birlik ve askeri kurum dışında ise sivil elbiseli olarak bulunacaktır. 10. İaşe-İbate: a. MAP, eğitimin verileceği Komutanlığın sosyal tesislerinden (misafirhane, tabldot vb.), imkanlar dahilinde ve EKB'de yer alan giyim-kuşam, kılık-kıyafet ve güvenlikle ilgili ulusal mevzuata uymak koşuluyla, her yıl T.C. Genelkurmay Başkanlığı tarafından belirlenen tarife üzerinden ve ücreti karşılığında faydalanabilecektir. b. İbate imkanlarının yetersiz kalması veya MAP'ın arzu etmesi halinde ihtiyaçlarını kendi olanakları ile birlik dışından karşılayabilecektir. 4 BÖLÜM VIII ZARAR, ZİYAN VE TAZMİNATLAR 1. MAP'ın görevi esnasında, görevin ifası dolayısıyla veya görev haricinde KED'in mallarına verdikleri her türlü zarar ve hasar KED tarafından oluşturulacak bir bilirkişi heyeti tarafından tespit edilir. GD isterse gözlemci sıfatıyla bu heyette temsilci bulundurabilir. MAP'ın KED'e ait gerçek ve tüzel kişilere verecekleri zarar ve hasarlar KED adli makamlarınca çözümlenir. Bilirkişi heyetinin tespit ettiği zarar miktarı GD tarafından üç ay içinde KED hesabına ödenir. 2. Tazminat miktarının GD tarafından kabul edilmemesi veya KED'e ait gerçek ve tüzel kişilerce uygun bulunmaması ve bilirkişi heyetinin kararının tebliğinden itibaren üç ay içinde itiraz edilmesi halinde ihtilaf, KED adli mercileri tarafından çözümlenir. Bu mercilerce verilecek karar kesin olup, taraflar açısından bağlayıcılık taşır. BÖLÜM IX CEZA YARGI YETKİSİ MAP ile yakınları, ceza ve yargı usulleri bakımından NATO/SOFA anlaşması hükümlerine tabi olacaktır. BÖLÜM X GİZLİ BİLGİLERİN GÜVENLİĞİ 1. Taraflar, görevleri süresince elde ettikleri gizlilik dereceli bilgilerin güvenliğini sağlamayı taahhüt ederler. 2. Gizlilik dereceli bilgiler tarafların yazılı müsaadeleri alınmadan hükümete, firmaya veya herhangi bir şahsa iletilmeyecektir. 3. Bu protokol ile ilgili olarak mübadele edilen ya da hazırlanan tüm gizlilik dereceli bilgiler veya materyal, tarafların yürürlükteki ulusal güvenlik yasa ve yönetmeliklerine uygun şekilde kullanılacak, muhafaza edilecek, iletilecek, sevk edilecek ve emniyeti sağlanacaktır. Ancak bunun için söz konusu bilgilere ve materyale, "Kuzey Atlantik Teşkilatı'nda Güvenlik" konulu ve CM (2002) 49 sayılı doküman ile bu dokümanın müteakip eklerinde ayrıntılı şekilde belirtilen NATO'nun gizlilik dereceli bilgilerine verilen koruma derecesinden daha düşük olanının verilmemiş olması gereklidir. BÖLÜM XI MÜTEFERRİK 1. KED uçuş eğitim sistemi kapsamında yapılacak değişikliklere bağlı olarak, işbu protokolde de gerekli değişiklikler yapılabilecektir. 2. KED olağanüstü hallerde (gerginlik, seferberlik, savaş halleri ve doğal afetler gibi) bu protokolle düzenlenen tüm eğitim faaliyetlerini durdurma, erteleme ya da sona erdirme hakkını saklı tutar. Bu koşullar altında eğitim ücretleri, taraflar arasında yapılacak karşılıklı görüşmelerle belirlenecektir. Taraflar arasında koordinasyon için aşağıdaki adresler kullanılacaktır. Bu durumda yazılı bildirimin yapıldığı tarihten itibaren en geç 30 gün içinde görüşmelere başlanacaktır. Müteakip 45 gün içinde görüşmelerden bir sonuç alınamaz ise, Taraflardan herhangi biri 30 günlük yazılı bir ön bildirimle bu protokolü sona erdirebilecektir. BÖLÜM XIV YÜRÜRLÜK SÜRESİ VE SONA ERDİRME 1. Bu protokolün yürürlük süresi 1 (bir) yıldır ve protokolün yürürlük süresinin bitiminden üç ay öncesine kadar, Taraflardan birisinin yazılı bir fesih talebi bulanmaz ise yürürlülük süresi 1 (bir) yıl daha uzamış kabul edilecektir. 2. Taraflardan biri diğer tarafın bu protokol hükümlerine uymadığı veya uyamadığı sonucuna vardığı takdirde yazılı olarak istişare önerisinde bulunabilecektir. Bu istişareler, yazılı bildirimin yapıldığı tarihten itibaren 30 gün içinde başlatılacaktır. Müteakip 45 gün içinde bir sonuca varılamaz ise, Taraflardan herhangi biri 30 günlük yazılı bir bildirimle bu protokolü sona erdirebilir. TÜRKİYE CUMHURİYETİ İTALYA CUMHURİYETİ GENELKURMAY BAŞKANLIĞI ADINA SAVUNMA BAKANLIĞI ADINA Sinan ŞANLI Claudio DEBERTOLIS Hava Pilot Tuğgeneral Tümgeneral Hava Kuvvetleri Komutanlığı, Hava Kuvvetleri Komutanlığı, Eğitim Daire Başkanı Eğitim ve Harekat Başkanı 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 THE PROTOCOL BETWEEN THE TURKISH GENERAL STAFF OF THE TURKISH REPUBLIC AND THE MINISTRY OF DEFENCE OF THE ITALIAN REPUBLIC ON THE F-16 PILOT TRAINING TO BE PROVIDED BY TuAF TO THE PERSONNEL OF THE ITALIAN AIR FORCE INTRODUCTION The Turkish General Staff and The Ministry of Defence of The Italian Republic (hereinafter the Parties); In order to contribute to the specified training matters in the Article III of the North Atlantic Treaty dated April 4, 1949; in accordance with the "Agreement on the Status of the Forces affiliated to the North Atlantic Treaty" dated 10 June 1951 (NATO SOFA) to determine the status of the Sending Nation's personnel, and the present and ongoing bilateral friendship and considering the importance of the contribution that the provision of flight training in F-16 aircraft by the Turkish Air Force to the personnel of the Italian Air Force will make to the present good relations, Have agreed to determine the bases of the training as follows: SECTION I PURPOSE The purpose of this protocol is to determine the principles and the responsibilities regarding F-16 Flight Training to be given in Turkey by Turkish Air Force (TuAF) to the personnel of Italian Air Force (ItAF). SECTION II SCOPE This protocol covers the Italian Air Force and the personnel of the Italian Air Force to receive Flight Training in Turkey as well as the concerned training units of the Turkish Air Force that will provide the flight training. SECTION III DEFINITION OF TERMS For the purpose of this protocol, the following definitions will have the meanings hereunder assigned to them. 1. "Sending Nation (SN)" means the Nation that will send the military personnel for the purpose of this protocol. 2. "Receiving Nation (RN)" means the Nation that will host the military personnel for training purposes. 3. "Guest Military Personnel (GMP)" is the military personnel (officer/ non-commissioned officer) who are the members of the Air Force of the Sending Nation to receive training at the training institutions of the Receiving Nation. 4. "Dependant" shall mean the spouse and children Guest Military Personnel (GMP), depending on him or her for support, in accordance with laws of his/her own country. SECTION IV PRINCIPLES AND RESPONSIBILITIES REGARDING THE TRAINING 1. The Responsibilities of the Receiving Nation: a. In accordance with the principles of this protocol and within the existing capabilities, The RN Air Force Command will ensure to provide the training and courses defined in this agreement to the GMP in return for the 25 payment of the amount specified in the frame of this agreement. b. The training and courses to be provided are stated in paragraph 3. 2. The Responsibilities of the Sending Nation: a. The SN is responsible to select and notify the level of readiness required by the GMP (specified in the paragraph 4). The RN shall take measures to control these conditions. b. The SN will submit, before the GMP arrive in Turkey, the authorities of the RN an approved health report from a fully equipped hospital for each GMP which states that they haven't had a permanent disease, they aren't presently infected by any virus (HIV, HEPATITIS, etc.), they don't have any type of health problems that would prevent flying fighter aircraft. In addition to that, after the GMP has arrived in Turkey, another similar health report will be taken for each GMP from a hospital determined by the RN. In case an illness that will hinder flight is diagnosed, that the GMP will be sent back to their home country. c. All travel expenses, related to the GMP's arrival in and departure from the RN as well as within the borders of the RN will be covered by the SN. 3. Training and Courses to be given to the Personnel of the SN: a. Pilot Health Examination and G-LAB Training. b. F-16 Ground Lessons (At the Squadron and at the Technical Training Center). c. F-16 Simulator Training. d. F-16 Flight Training in F-16 BLOCK 30/40 aircraft (23.00 hours/18 sorties). e. In case requested by the SN, additional courses and training will be given by the RN in return for the payment to be specified in additional Technical Arrangements. 4. Qualifications Required for the Personnel that will participate in Training: a. To have a grade of 85 ECL English Language Level (English Comprehension Level Examination will be performed by the RN in Turkey.) b. Results of the medical examination should be as "suitable to be a fighter pilot" (the RN will conduct medical examination in return for the payment.) c. Prerequisites for F-16 Flight Training Program; (1) The trainees shall have no incidents arising from the pilot error. (2) To be an at least three-year flight personnel at a detachment (Combat Ready) or to have completed 500-hour-fighter jet flight, (3) Not to have a more-than-90-day break in flight before the starting date of training in Turkey. d. The GMP must have the required NATO Clearance Certificate to have access to NATO Classified documents. The GMP must submit this certificate to the RN authorities when he/she starts duty. e. Any GMP who is determined as not having the prerequisites stated above will be sent back to his/her home country before he/she starts training. 26 5. Principles of the Training: a. The RN shall give the training mentioned in this agreement within the scope of its own national law, regulations, legislation, directives, orders and training programs. b. Training will be provided in English. c. The GMP to be trained shall not interrupt the training under any circumstances, and will obey the working hours and calendar of the unit. 6. Training Periods: a. Pilot Health Examination and G-LAB Training lasts for 3 work days. b. F-16 Aircraft Technical Training lasts for 10 work days. c. F-16 Squadron Ground Lessons are 144 hours. d. F-16 Simulator Training is 12 hours/9 sorties. e. The total duration of this training (23.00 hours/18 sorties) is 69 work days. f. The RN reserves the right to make changes on the flight hours and number of sorties according to the requirement in accordance with the SN. 7. Training Fees: a. The fees related to the courses and training determined by the RN is specified in the Annex-A. b. The RN will prepare two copies of original invoices when the training ended and send these invoices to the authorities of the SN. c. The invoice amount will be deposited as US Dollar to the account of Ministry of National Defense at the Central Bank Ankara Branch Exchange Account No: 85-859-001-021 and a copy of the deposit will be sent to The RN Air Force Command. d. For the invoices which have not been paid within 90 of reception by the SN through Turkish Military Attache in have to add a monthly default interest to the sum of money default interest will be calculated in accordance with the interest applicable on the date of payment. days after the date Rome, the RN will in US Dollars. The fees regarding the supplementary training requirements (such as synthetic, academic, flights, health examination etc.) that can be required thereafter or inserted into the pre-scheduled programmes other than the training programmes specified therein shall be accounted and acquired additionally. No additional charges are requested for the sorties cancelled due to meteorological conditions, emergency situations or the order of the Base Commander of the RN. 8. Conditions for Termination of the Training: In the cases where the GMP can not attend the training due to health problems, failure in training or undisciplined behaviors, he/she may be sent to his/her home country if deemed necessary after an evaluation of these acts according to the laws, regulations, rules, directives of the RN. 27 SECTION V HEALTH SERVICES 1. The GMP and their dependants will benefit from the services (examination, treatment, analysis, medicine etc.) of the military/civilian health care institutions on a reimbursable basis. 2. In case of emergencies, no payment will be requested for emergency treatment, ambulance service to the nearest military/civilian health care institution. 3. If a GMP states his/her health problem and requests to be examined and treated at a military hospital, his unit will send him to a military health institution. The payment for the examination, treatment, analysis, medicine, etc. given to the GMP or his/her attendants will be deposited by Military Attache/Embassy of the SN to the account of the Ministry of National Defense at the Central Bank which is stated in SECTION IV-7c. 4. All periodical health examinations that are applied to the flight personnel of the RN, shall also be applied to the GMP on a reimbursable basis. 5. In case of death of a GMP or his/her dependants while on duty or off duty within the borders of the RN, the RN will immediately notify the authorities of the SN, the SN will either make a decision to receive burial services in the RN or determine for transportation by air to the SN. SECTION VI CUSTOMS PROCEDURES 1. The GMP will be subject to the RN customs procedures when entering/leaving the country or during his/her stay in the RN. 2. The GMP will not carry diplomatic passport and will be subject to legal provisions that apply to foreigners' residence and traveling in the RN country. Residence permit and similar charges will be covered by the SN or the GMP. SECTION VII ADMINISTRATIVE PRINCIPLES 1. The RN, will prepare quarterly reports concerning the GMP's discipline, training, health, etc. and present it to the competent the SN authorities. If need arises annual PMR (Program Management Review) meetings will be alternately held in Turkey and Italy. 2. The RN will keep flight records of the GMP in a separate file. Following the completion of training, the RN will forward to the SN authorities all records concerning the GMP (flight, medical, discipline, etc.), the level he/she has attained at the end of training and an "Assessment of the Outcomes" report including measurable outcomes of the training he/she has received. 3. If required, a liaison officer can be appointed in the RN by the SN for administrative purposes. In the case where a liaison officer is not appointed, the task in question is to be carried out by the most senior personnel among the GMP. 4. Unit Command shall issue visitor military personnel ID cards for the GMP. The GMPs are obliged to carry these ID cards with them. Before returning home, ID cards submitted to the GMP will be returned to the Command that carries out the termination procedures. 5. During the training, the GMPs are obliged to obey all the relevant disciplinary laws, regulations and command directives applicable to the RN personnel. The following provisions on the discipline procedures shall be applied: 28 a. The RN Authorities do not have the authority to give a disciplinary punishment to the GMP. The SN authorities will be notified in writing of the discipline violations related to duty or not. b. The GMP is not authorized to perform disciplinary command on the RN military personnel. Yet, he/she can order the personnel under his/her command on matters related to duty. 6. The GMP has the right to acquire and drive a personal vehicle within the borders of the RN. Similarly, he/she is also obliged to obey all the traffic rules and existing laws applied to the RN personnel. 7. Throughout the courses and training the GMPs' holidays and leaves will be organized according to national days and religious holidays in the RN. Yet, the GMP may be entitled to have leaves provided that the SN announces its national days or religious holidays in advance. 8. Financial issues: Throughout the training, the SN will be responsible for the following expenditures concerning the GMP: a. Expenditures on services such as training, health, clothing, etc. that are provided by the RN and that have been explicitly mentioned in the Sections of this protocol. b. Salaries, travel expenses and wages that the GMP is entitled to. c. All transfer expenses of the GMP's dependants that arise during the arrival and departure of them and their belongings to/from the RN. d. All expenses that arise concerning the burial and/or transportation to their country in case of death of the GMP's dependants. e. Expenses with regard to the GMP missions to be conducted on behalf of the SN. f. The relevant travel expenses of a GMP and his/her dependants within or outside the borders of the RN. 9. Clothing: a. Winter and summer flight petticoat, flight jacket, flight boots, gloves and all other equipment required for flight training and courses are to be supplied by the SN. b. At the request of the SN, flight equipment shall be supplied by the RN on a reimbursable basis. Standardization in clothing of the GMP is to be furnished by the SN. c. The GMP will wear a military insignia, given by the RN, on his/her flight suit and uniform for recognition. d. Throughout the training the GMP will wear his/her national uniform within the RN institutions. He/she may wear civilian clothing outside the military institutions and units. 10. Facilities: a. The GMP will get used by the social facilities (guesthouse, messing facility, etc.) of the Command in responsible of the trainings to be conducted, where available, in return for disbursement due to the rate annually predetermined by the Turkish General Staff in compliance with the national legislation on dressing, uniforms and security summarized in the Annex-B. b. In case the facilities reserved for accommodation do not meet the potential demand properly or if they desire so, the GMP may get used by the civilian facilities outside the base for accommodation depending upon their own personal availability. 29 SECTION VIII DAMAGE, LOSS AND INDEMNIFICATION 1. All kinds of loss and damage inflicted on the assets of the RN by the GMP due to/during the implementation of mission or their off-duty period are determined by a commission of experts. The SN, if desires so, could designate a representative to the commission of experts as an observer. Loss and damages to be inflicted on the real and legal personalities of the RN by the GMP are resolved by the competent legal authorities of the RN. Once the amount of indemnification arising from the loss and damage is determined by the aforementioned commission, the relevant cost must be deposited to the account of the RN within three months. 2. In case the amount of indemnification is not accepted by the SN or is contemplated to be inappropriate by the real and legal personalities of the RN, the dispute arising between the said Parties shall be resolved by the competent judicial authorities of the RN pursuant to the objection made within three months as of the date of notification issued by the commission of experts. The decision decreed by these authorities is final and the parties must comply with it. SECTION IX JURISDICTION The GMP and his family members will be subject to the relevant provisions of the NATO-SOFA Agreement. SECTION X SECURITY OF CLASSIFIED INFORMATION 1. The Parties guarantee the security of the classified information acquired on the course of their duty. 2. The classified information will not be forwarded to the government, firm or any person without the written permission of the Parties. 3. All classified information or material exchanged or generated in connection with this protocol, will be used stored transmitted handled and safeguarded in accordance with the Parties applicable national security laws and regulations, to the extent that they provide a degree of protection no less stringent than provided for NATO classified information as detailed in the document "Security Within The North Atlantic Organization" CM (2002) 49 and subsequent amendments. SECTION XI MISCELLANEOUS 1. This protocol may be amended with the mutual consent of the Parties. This protocol may be also amended if changes will be made in the RN flight training system. 2. In case of emergencies (such as tension, mobilization, war conditions or natural disasters) the RN will have the right to cease, delay or terminate all training activities arranged through this protocol. Under these circumstances, the training fees will be determined through mutual negotiations between the Parties. For the coordination between the Parties, the following addresses will be used. SECTION XIII AMENDMENTS AND REVIEWS Either Party could propose, with a written notification, changing or reviewing this protocol when necessary. In this case, the negotiations will commence within 30 days at the latest beginning from the date of the written notification is made. In the case that the Parties don't reach an agreement within the following 45 days, either Party could terminate this protocol through a 30-day written pre-notification. SECTION XIV DURATION AND TERMINATION 1. This protocol will be in force for 1 (one) year and can be extended one more year if the Parties agree about this, in a written from, three months prior to the termination date. 2. In case either Party reckons that the other Party cannot comply with one or more sections of this protocol, that Party can propose discussions through writing. The discussions will be started within 30 days after the written notification. If no resolution has been reached within the following 45 days, either Party can terminate the protocol with a thirty-day notification. SECTION XV ENTRY INTO FORCE This protocol including the Annexes will come into effect on the date of signature by the Parties. SECTION XVI TEXT AND SIGNATURE 1. Signed in duplicate Turkish, Italian, and English each copy having equivalent validity. However, in the event of a dispute on the wording of this protocol, the English version will prevail. 2. This protocol has been signed in Roma on the date of 26.08.2005 in accordance with the above provisions. COURSE DESCRIPTION: 1-1. Course Title: TuAF International Basic Operational Training Course (IB-COURSE). 1-2. Course Entry Prerequisites: a. As stated in the Protocol between TuAF and ItAF. b. G-Lab Training and Pilot Medical Check-up are successfully completed. 1-3. Purpose and Status upon Completion: The goal of this course is to produce F-16 pilots with basic proficiency in F-16 Air to Air conventional mission tasks. The graduates will be considered to have fulfilled all requirements as Air to Air limited combat ready pilot. Graduates will not be combat ready unless having completed orientation training of his/their assigned SQN. Other restrictions are as stated in the HKY 164-1 (B). 1-4. Location: 4th Main Jet Base, 142nd Squadron, Akıncı/ANKARA. 1-5. Duration: Following is based on a class of 4 students. 10 additional weekdays are required for each additional student. AIRCRAFT CONFIGURATIONS: 1.10 F-16 C/D Configurations: The following configurations apply to all student missions flown in this syllabus. Configuration-1: (Basic aircraft+CL tank+with AIM-9 DUMMY) Students will fly with configuration-1 on specifically TR, AHC, BFM, and ACM missions. 33 ANNEX-B RULES AND REGULATIONS TO BE FOLLOWED IN THE BACHELOR OFFICER'S QUARTERS (BOQs), OFFICER'S CLUBS AND RECREATION FACILITIES During the training, the GMP shall conform with all laws, regulations and commander orders for the discipline rules applied to the RN personnel. The GMP must obey orders of the commanding authority at the Unit, HQ or School where he/she is attached during the training period. All personnel benefiting from the military facilities shall conform to the rules determined by the laws and regulations. 1. Rules Pertaining Clothing in the Training Detachment: a. The GMP may wear their national daily flight suit, work uniform and indoor uniform appropriate for the training and the season. Flight suits and work uniforms will be used only in the quarters and the GMP are not allowed to wear their flight suits and work uniforms outside the quarters. b. If the GMP is male he may participate in the training on condition that he has his moustache and beard daily trimmed. 2. Rules and regulations to be followed at the officer's clubs, bachelor officer's quarters (BOQs), and recreation facilities. a. The GMP and their wife and their children, who are under 18 and single may benefit from the officer' clubs, bachelor officer's quarters, and recreation facilities (with the handicapped children there is no age limit). b. Men may use the facilities on condition that their moustache and beard are trimmed; and women are allowed to use the facilities as long as they are in modern dresses (skirt-jacket-trousers etc.), with uncovered head and face. c. The GMP and their attendants shall not behave in a way that might offend Turkish customs and traditions. 3. The GMP and their attendants are allowed to use the military installations in the following clothing: a. Service uniform, b. Proper attire for the winter season between the periods of October 15 May 14, (1) Neat and tidy coat, civilian attire with tie (leather or cloth jacket), (2) Denim jeans are not to be dirty, very tight, patched, nor tasseled; turtleneck pullover, civilian attire with (leather or denim) coat and jacket (except for dinner at the restaurant sections), c. Proper attire for the summer season between the periods of May 15October 14, (1) Neat and tidy trousers proper for summer with proper shirts and t-shirts (open-collared but breast buttoned), (2) Denim jeans are not to be dirty, very tight, patched, nor tasseled and proper shirts and t-shirts (open-collared but breast buttoned), civilian attire with denim jacket (also valid for dinner in the indoor restaurants), 4. It is strictly forbidden to enter any military installation with the following attires: a. Wearing training boots, military parka and anorak with civilian attire, 34 b. Wearing untidy and dirty clothes, having very long hair or dirty beards if the GMP does not have a permanent trimmed beard, c. Wearing non-modern or symbolizing a political or religious ideology or movement and tendency clothes, d. The personnel who can not be recognized from his/her photograph on his/her ID card or daily pass will not be allowed to enter the officer' clubs, bachelor officer's quarters and recreation facilities. 35
