TREE REPLACEMENT NOTICE
Tree preservation order: THE CRAWLEY BOROUGH (BALCOMBE ROAD
NO.6) TREE PRESERVATION ORDER 1971
1. THIS IS A FORMAL NOTICE which is served by the Council under section
207 of the Town and Country Planning Act 1990 (the Act) because it appears
to them that:
you have not complied with a duty to plant a tree under section 206 of
the Act.
2. THE LAND AFFECTED
Land at 11, Barn Close, Pound Hill, Crawley shown edged red on the attached
plan.
3. REASONS FOR SERVING NOTICE
On 9th November 2013 a protected Lime Tree (Tilia Europea) located in the
back garden of the above premises was felled without authorisation. On 11th
June 2014 you accepted a Formal Caution in respect of the offence of felling a
protected tree, having been informed that a Tree Replacement Notice would
be issued in respect of the tree.
4. WHAT YOU ARE REQUIRED TO DO
You are required to fell the remaining part of the damaged tree to ground
level, grind out as much of the stump and roots as is practicable, and to plant
one Tilia Cordata “Greenspire” or Tilia Tomentosa “Brabant” (Lime tree), as
close as possible to the location of the protected tree. The replacement tree
must have a girth of at least 80 centimetres at breast height (1.5 metres) and
should be supplied wire rootballed
Time for compliance: By 31st March 2015.
5. WHEN THIS NOTICE TAKES EFFECT
This notice takes effect on 1st October 2014 unless an appeal is made against
it beforehand.

YOUR RIGHT OF APPEAL
You can appeal to the Secretary of State for the Environment, Transport and
the Regions against this notice by writing to The Planning Inspectorate,
Environmental Appeals Team, Room 3/25 Hawk Wing, Temple Quay House,
2, The Square, Temple Quay, Bristol, BS1 6PN.
Your appeal must be received, or posted in time for it to be received, before
1st October 2014. You can appeal on any one or more of the following
grounds:
(1) that the provisions of the duty to replace trees or, as the case may be, the
conditions of consent requiring the replacement of trees, are not applicable or
have been complied with;
(2) that in all the circumstances of the case the duty to replace trees should be
dispensed with in relation to any tree;
(3) that the requirements of the notice are unreasonable in respect of the
period or the size or species of trees specified in it;
(4) that the planting of a tree or trees in accordance with the notice is not
required in the interests of amenity or would be contrary to the practice of
good forestry;
(5) that the place on which the tree is or trees are required to be planted is
unsuitable for that purpose.
You must also state the facts on which your appeal is based.
FAILURE TO COMPLY
If you do not comply with this notice, the Council may enter the land, plant the
tree(s) and recover from you any reasonable expenses incurred.

verilen RESMİ BİR TEBLİGATTIR zira görünüş o ki
Yasanın 206'ıncı bölümü uyarınca bir ağaç dikme görevini yerine
getirmediniz.
2. ETKİLENEN ARAZİ
Ekteki planda kırmızı kenarlı olarak 11, Barn Close, Pound Hill,
Crawley'de gösterilen arazi.
3. TEBLİGATIN SUNULUŞ NEDENLERİ
9 Kasım 2013 tarihinde, yukarıda belirtilen mülkün bahçesinde bulunan
koruma altındaki bir Ihlamur ağacı (Tilia Europea)izinsiz olarak
kesilmiştir. 11 Haziran 2014 tarihinde ağaçla ilgili bir Ağaç Yenileme
Tebligatı sunulacağı konusunda bilgilendirilmiş olarak, koruma altında
bulunan bir ağacın kesilmesi suçuna ilişkin olarak Resmi bir Uyarıyı
kabul ettiniz.
4. NE YAPMANIZ GEREKİYOR
Ağacın geri kalan kısmını yere kadar kesmeniz, kütüğü ve kökleri
mümkün olduğu kadar rendelemeniz, ve koruma altındaki ağacın
bulunduğu yere mümkün olduğu kadar yakın bir şekilde, bir Tilia
Cordata "Greenspire" veya Tilia Tomentosa "Brabant" (Ihlamur ağacı)
dikmeniz gerekiyor. Yeri alacak olan ağacın göğüs yüksekliğinde ki (1.5
metre) cevre genişliği en az 80 santimetre olmalıdır ve kök telle
yumaklanmış olmalıdır.
Uygulama zamanı: 31 Mart 2015 tarihine kadar.
5. TEBLİGAT NE ZAMAN YÜRÜRLÜĞE GİRECEK
Öncesinde bir temyiz başvurusu yapılmadıkça bu tebligat 1 Ekim 2014
tarihinde yürürlüğe girecektir.

sorumluluğu herhangi bir ağaç ile ilgili olarak tevzi edilmelidir.
(3)Tebligatın gereklililleri, süre ve adı geçen ağacın cinsi ve büyüklüğü
açısından makul değildir.
(4)Tebligat uyarınca bir ağacın ya da ağaçların dikilmesi hoş görünüş
açısından gerekli değildir veya iyi ağaçlandırma uygulamalarına
aykırıdır.
(5)Ağacın veya ağaçların dikilmesi istenen yer bu amaç için müsait
değildir.
Ayrıca itirazınızın dayandığı unsurlarıda listelemeniz gerekir.
UYMAMA DURUMUNDA
Bu tebligata uymaz iseniz, belediye araziye girebilir, ağacı(ları) dikebilir
ve meydana gelen, makul orandaki masrafları sizden geri alabilir.
