Ameliyat indikasyonu konmadan önce jinekolojik, ürolojik ve rektal muayeneler hastalarda utanma ve tedirginlik yaratmaktadır. Sadece bu nedenle doktora başvuru gecikmekte ve malignite evresini artırmaktadır. Bu utanma duygusunu yenerek doktora başvuran hastalara ameliyat indikasyonu söylendiğinde ölüm korkusu devreye girmektedir. İşte bu nedenlerle doktorun hastayla kuracağı iletişim, konuşma süresince seçeceği kelimeler, davranış ve tavırları utanma ve ölüm korkusunu hastaya yaşatmamalıdır. Hastaya öncelikle huzur ve güven duygusu verilebilmeli; hasta doktorun yanından ayrılırken endişe ve telaş içinde olmamalı, "Doktorumu buldum, bana yardım edecek, şifaya kavuşacağım" duygusunda olmalıdır. Bu paneldeki amaç, uzun meslek yılları içinde edindikleri mesleki-bilgi ve becerilerini aktarmak ve etik duyarlılık kazandırmayı hedeflemek olan Cerrahi Hocaların hasta-hekim iletişimindeki deneyimlerini yetişmekte olan genç Cerrahlara anlatıp, cerrahi kliniklerde etik konusunu paylaşmak ve tartışmaktır. However the conditions for a research use of these removed tissues including residual materials, so called “left overs”, are still in discussion. Is it e.g. justified to assume a “silent” or implicit consent of the donor for research on his material when the removal has been carried out in a hospital known as research institution, usually a University hospital? Can these materials be stored only for an immediate research project or is storage for any scientific use in the future permitted? Is for the latter case a general consent appropriate or is there a need for a specific consent to reuse the stored material? The Council of Europe has taken a distinct position by two legal instruments, elaborated in the frame of the Oviedo Convention: the “Additional Protocol to the Convention on Human Rights and Biomedicine Concerning Biomedical Research” (Council of Europe Treaty Series - No. 195) and the “Recommendation Rec(2006)4 of the Committee of Ministers to member states on research on biological materials of human origin”. It is clearly stated that research on removed human materials including residual materials may only be carried out with the free informed consent of the donor. The consent to remove material for health care purposes does not cover any research use. The removal of material only for research purposes needs a specific consent which includes removal and research use. The storage of removed materials for research in the future is only acceptable with a specific consent introduced into a legal instrument by the above mentioned Recommendation and meanwhile known as “broad consent”. This consent is a consent under certain conditions and must not be confused with a consent without any conditions, often addressed as “blanket consent”. ÖZEL KONFERANS/SPECIAL CONFERENCE AVERROISM AND SUNRISE OF THE PADUA UNIVERSITY SCHOOL OF MEDICINE Giorgio Zanchin Department of Neurosciences, Padua University School of Medicine e-mail: [email protected] Almost to the origins of the University of Padua (1222), we meet Pietro d’Abano (ca. 1250 – ca. 1315), an icon figure who was considered as the father of the Paduan Medical School. Physician and philosopher, he had stayed in Constantinople to directly study the medical works of classical antiquity. He also visited Paris, where he taught medicine with resounding success. From the 12th century the West commenced its discovery of several classical, philosophical and medical texts. Especially the teachings of the so-called “physical” writings of Aristotle revived philosophical and medical texts. Especially the teachings of the so-called “physical” writings of Aristotle revived interest in the study of nature as opposed to themes centred on afterlife. These trends took shape in the medical framework with the anatomical examination of the human body. Some scholars deem that Pietro d’Abano, whose principal work, Conciliator controversiarum quae inter philosophos et medicos versantur, attempts to converge abstract reason and empirical observation, brought with him to Padua a trend of thought that followed Aristotle’s teachings as interpreted by the Arab philosopher Averroes (1126-1198). Said line of thought was named after him as Averroism, which announced the “doctrine of double truth”: which, by stating the clear separation between faith and data obtained from the study of nature, aimed on allowing and protecting exploratory investigation. This seems to have been one of the foundations of freedom of thought at the origins of the outstanding accomplishments of the Medical School of Padua, expressed in the motto Universa universis patavina libertas, which identifies this University in the course of its history. ETİK VE HUKUK AÇISINDAN YAŞAMIN SON DÖNEMİNDE SORUNLAR Problems related to end-of-life care: An evaluation from the perspectives of Medical Ethics and Medical Law Murat Civaner Uludağ Üniversitesi Tıp Fakültesi Tıp Tarihi ve Etik AD e-mail: [email protected] Tıp Etiği Açısından… Yaşamın son dönemindeki etik sorunlarını tıp etiği açısından tanımlarken ve tartışırken, özetle üç temel sorunun önemli derecede etkili olduğundan söz edilebilir: Yaşamın son döneminde etik sorunları dendiğinde ilk akla gelen başlık genellikle ötanazi olmaktadır. Bu başlığın popüler olmasının çeşitli nedenleri olabilir; ancak ötanazi yaşamın son döneminde etik sorunu oluşturan pek çok başlıktan yalnızca biridir. Konuyu ötanazi başlığına daraltarak ele almak, başta gereksinilen sağlık hizmetine erişim ve ağrı tedavisi olmak üzere pek çok sorun kümesinin görmezden gelinmesine yol açmaktadır. Yaşamın son dönemine yaklaşımımızı belirleyen etmenleri dikkate almamak, etik sorunlarını ele alış biçimimizi sorunlu kılmaktadır. Yaşlılığın, yaşamın son döneminin ve ölümün kültürel anlamlandırılışı, tüketim toplumunda sağlık-hastalık, gençlik-yaşlılık, yaşam-ölüm kavramlarının tanımlanışı ve buna müdahil olan aktörler (ilaç ve tıbbi teknoloji şirketleri, medya, politika-belirleyenler vs), tıbbın toplumsal bir kurum olarak müdahale “arzusu” / Yaşamın-ölümün tıpsallaştırılması, “Kişi” ve “kişi özerkliği” kavramlarının toplumdaki konumlanışı ve geçerli sağlık politikaları sorunları çevreleyen ve önemli derecede belirleyen bağlamı oluşturmaktadır. Bağlamı dikkate almayan analizler makro ölçeğin mikro ölçek / hekim-hasta ilişkisi üzerine etkisini görmeyerek sorunu eksikli tanımlamakta ve öneri geliştirmekte yetersiz kalmaktadır. Yaşamın son döneminde etik sorunlarını ele alırken yaşamın değeri, kişi kavramı, kaynakların kısıtlılığı söylemi ve maliyet-etkinlik gibi kavramların yeterince tartışıldığını ileri sürmek güçtür. “Yaşamın değeri nasıl belirlenebilir?”, “Sayısal olarak ölçülebilir mi?”, “Hangi ölçütler dikkate alınmalı?”, “Ödeme gücü bir ölçüt olabilir mi?”, “Her insan kişi midir?”, “Kişi olmanın koşulları nelerdir?”, “Kişi olmayanlara nasıl davranmalıyız?” gibi sorular üzerine sağlam gerekçeli (=temel hakları koruyan) yanıtlara gereksinim olduğu açıktır. Belki daha önemlisi, sağlık hizmetlerini özelleştirildiği ve bir tür piyasaya dönüştürüldüğü günümüzde “kaynakların kısıtlı olduğu” ve “maliyet-etkinlik ölçütünün sağlık hizmetiyle uyumlu olduğu” iddialarının neredeyse bir doğa yasası gibi tartışmasız kabul ediliyor olmasıdır. Bu tür savların gerçekliğini tartışmadan kabul etmek, yaşamın son döneminde ortaya çıkan etik sorunlarının analizinde onulmaz bir körlüğe yol açmaktadır. Tıp Hukuku Açısından... Yaşamlarının son dönemindeki hastalara hizmet sunan sağlık çalışanları, sıklıkla; “Endikasyon olmaması nedeniyle tedaviye başlamamak ötanazi midir?”, “Endikasyonun ortadan kalkması nedeniyle tedaviyi kesmek ötanazi kapsamına girer mi?”, “Tedaviyi reddeden hastanın kararına saygı gösterirsem ve hasta yaşamını yitirirse hukuken adam öldürme suçunu işlemiş olur muyum?”, “Tıbbi girişimler ne zaman ‘boşuna tedavi’ kapsamına girer?” gibi soruların hukuk tarafından nasıl yanıtlanacağını bilmek isterler. Böylesi güç sorular karşısında bilgisizliğin ve yasal düzenlemelerin yetersizliğinin yarattığı kaygı, güvenli tarafa hata yapılmasına, endikasyon olmadığı ve/veya hastanın iradesiyle uyumlu olmadığı halde tıbbi girişimlere “sonuna kadar” devam edilmesine yol açabilir. Bu defansif yaklaşım, özerklik ihlali bir yana, kaynakların boşa harcanmasına ve başka hastaların hizmete erişiminin kısıtlanmasına neden olmaktadır. Öneriler Konu ötanazi’ye daraltılmadan, bağlamı ve tüm belirleyenleriyle birlikte, özellikle makro düzey / sağlık politikalarının etkilerini görerek ele alınmalıdır. Sağlık hizmetlerinin maliyet-etkinlik ölçütüne göre sunulmasına, hizmetin sayısal ölçülmesine, rekabet, verimlilik, kârlılık gibi iş dünyasına ait kavramların tıbba transferine, kaynakların kısıtlı olduğu söylemine ısrarla karşı çıkılmalıdır. Tanımlamaları / sınıflamaları mesleki değerler ve sağlık hakkı ekseninde oluşturmalı / savunmalıdır. Pasif ötanazi tanımına dair hatalı bilgiler ve inanışlar geniş kapsamlı bilgilendirme çalışmalarıyla düzeltilmeye çalışılmalıdır. Palyatif bakım hizmeti örgütlenmeli ve kamusal bir hizmet olarak ücretsiz sunulmalıdır. Ağrı tedavisine eğitimde ve hizmet sunumunda özel önem verilmelidir. Hastanelerde klinik etik danışımı için yapılanmalar oluşturulmalıdır. Yasal düzenlemeler, hekimin klinik kararlarını, sağlık hakkı ve hasta haklarını gözeterek almasını sağlayacak ve defansif tıbbi önleyecek derecede yönlendirici olmalıdır. Tıbbi Vasiyet uygulamaya geçirilmelidir. It is possible to claim that there are three fundamental issues are substantially influential on how we describe and discuss the ethical problems related end-of-life care: Generally euthanasia is the first headline that comes to our minds when we think about the ethical problems related end-of-life care. This popularity might be caused from several reasons; however euthanasia is just one of the topics that creates the ethically challenging situations. If we narrow down the whole subject into euthanasia it might lead us to overlook lots of problems including access to healthcare and pain management. If we do not pay attention to the factors that shape our approach to end-of-life care, the way we handle ethical problems would be defected. Cultural meaning of getting old, last period of life and death; describing health-illness, youth-senility, life-death concepts in a consumer society and the actors influencing the perceptions (pharmaceutical and medical technology companies, media, policy makers etc.); intervention ‘wish’ of medicine as a social instituyion, medicalization of life and death; societal meaning and values of “personhood” and “autonomy”, and finally actual health policies create a context which encircles and determinates the ethical problems. Ethical analysis that does not take into consideration this context would miss the effects of macro scale to the micro scale/doctorpatient relationship. Therefore the problems would be misdescribed, related suggestions would be unrealistic and eventually fail. It is hard to say that the concepts such as value of life, personhood, discourse of limited resources and cost-effectiveness have been deliberatedenough while the ethical problems related end-of-life care are discussed. It is clear that we need strongly justified answers to the questions such as “How can we determine the value of life?”, “Can it be evaluated by numbers?”, “Which measures are important?”, “Can ability to pay be a criterion?”, “Is every human being is a person?”, “What are the terms of being a person?”, or “How should we treat the ones who is not a person?”. Nowadays maybe it’s more important that the claims of that resources are limited, or that cost-effectiveness measure is competent with the nature of healthcare are accepted as law of nature. To accept those claims without any critical appraisal causes a kind of blindness in the analysis of ethical problems. From the perspective of medical law, there are many concerns healthcare workers have. They would like to know the legal answers of many questions such as “Would it be euthanasia if a physician withholds or withdraws treatment when there is no medical indication?”, “Would I commit homicide if I respect the autonomous decision of my patient and let her die?”, “Under which conditions a treatment is counted as futile?” Lack of knowledge and insufficiency of legal regulations may lead them to err on the safe side, and treat the patients without any medical indication or an appropriate consent. This defensive approach violates patient autonomy and wastes resources which could save another patient’s lives. Suggestions Moral deliberations should not be narrowed down into ‘neon’ subjects like euthanasia. All of the concepts and determinants, especially macro level’s / health policies’ effects should be taken into consideration. Pain management should be a priority both in undergraduate and in continuous medical education. Wrongful knowledge and beliefs about passive euthanasia concept must be corrected with widespread training. Palliative care must be organized and provided free as a public service. Clinical ethics consultation should be organized as a service in hospitals. Advance directive should be legally regulated. Legal regulations should be leading enough to make decisions that protect patient rights and professional values, and prevent defensive medicine. CERRAHİ MÜDAHALELERDE HEKİMİN HUKUKİ SORUMLULUĞU Legal Liability of Physicians in the Practise of Surgery Fulya İlçin Gönenç Medipol Üniversitesi Hukuk Fakültesi e-mail:[email protected] Günümüzde, hasta ve sağlık çalışanları arasındaki ilişkiler tıbbi teknolojinin gelişmesiyle hızla değişirken, tıbbi uygulamalarda kişinin sağlığı ve vucut bütünlüğü çerçevesinde yeni ve karmaşık tıp hukuku ikilemleri ortaya çıkmaktadır. Sunumda mevcut hukuki düzenlemeler ve uluslararası bildirgeler çerçevesinde hasta hakları ve hekimin hukuki sorumluluğu yanında tıbbi uygulama hataları sosyo-ekonomik ve siyasi yönüyle incelenecektir. Today, new and complex medico-legal dilemmas are arising in medical practice in the context of human health and physical integrity of the individual while relationships between patients and health care professionals are rapidly changing with advancement in medical technology. This paper analyzes medical malpractice in its socioeconomic and political context as well as patient rights and legal liability of physicians in accordance with existing legal arrangements and international declarations. YENİDOĞAN DÖNEMİNDE İNVAZİF GİRİŞİMLER VE ETİK “Invasive Procedures During the Neonatal Period and Ethics” Elif Vatanoğlu Lutz Yeditepe Üniversitesi Tıp Fakültesi, Tıp Tarihi ve Etik Anabilim Dalı e-mail: [email protected] Yenidoğan dönemine ait tedavi kararları, kendine özgü etik sorun kümeleriyle yüklüdür. Yenidoğanın üstün yararının korunmasından, yaşam kalitesinin gözetilmesine, kıt kaynakların paylaştırılmasından ebeveynlerin aydınlatılmasına, toplumun yararının hesaba katılmasından yenidoğan ötenazisine, yaşamı destekleyen tedavilerdeki etik yükümlülüklerden cerrahi girişimlerle ilgili karar vermeye kadar uzanan geniş bir yelpazede etik konular göze çarpmaktadır. İhtiyacı olan her yenidoğan doğum haftasına ya da hastalığına bakılmaksızın tedavi edilmeli midir? Tedaviye başlandıktan sonra yenidoğanın yaşamının çok ciddi sakatlıklarla yaşayabileceği öngörülse bile tedavi sürüdürülmeli midir? Öngörülen tedavinin yenidoğana getireceği yarar ve zarar hakkında bilimsel kanıtlar geçerli ve güvenilir midir? Yenidoğana yararı tartışmalı olan bir tedaviye başlanacaksa ya da sürdürülecekse ciddi sakatlığı bulunan bu bebeğin bakımından ve tedavinin maliyetinden kim sorumlu tutulmalıdır? Ebeveynler karar verme hakkına sahip midir; tercihlerinin sınırı var mıdır? Ebeveynler dışında kimler tedaviye başlamama ya da sonlandırma kararı verme hakkına sahiptir ve bakım vericinin kararlardaki rolü ne olmalıdır? Kontrol edilemeyen ağrı acı çeken yenidoğanın ölmesine yardım edilmeli midir? Tüm bu sorular, cevaplanması güç ve yoğun etik tartışma gerektiren sorulardan birkaçı olarak sıralanabilir. Bu bildiride, bu soruların ışığında; yenidoğan dönemindeki invazif girişimlere yönelik genel bir çerçeve çizilecektir. The treatment decisions in the neonatal period are full of spesific ethical problems. Protection of the high benefits of the baby in the neonatal period, quality of life, distribution of the scarce resources, informed condent of the parents, the benecicence of the society, euthanasia in ther neonatal period, ethical discussions about the life supporting treatments and decisions about operation could be given as examples of these spesific ethical questions. Do we need to do treat all the babies who need treatment in the neonatal period regardless from the gestational age and sicknesses? After starting the treatment, does it have to be continued although it is fore seen that the baby will have serious disabilities in the future? Are the scientific data about the potential harm and the benefit of the suggested treatment accurate and appropriate? Who will be responsible to sponsor all the expenses of a treatment which has unclear positive results? Do the parents have the full decision capacity; do they have a limit for thier decisions? Who can be the decision maker about withholding or withdrawing a treatment apart from the parents? What is the role of the caregiver in these decisions? Do we need to help a neonate to die if he/she has uncontrollable pain? All these questions are a few examples of difficult ethical questions that need heavy discussions and brain storming in the issue. In this paper,under the light of all these questions; it is aimed to draw a general perspective about the ethical problems of invasive procedures during the neonatal period. BERLİN/ALMANYA'DA TERMİNAL DÖNEM HASTALARI VE HOSPİZ BAKIMI [GÖRSEL SUNUM EŞLİĞİNDE ETİK BİR DEĞERLENDİRME] Terminal Stage Patients and Hospice Care in Berlin/Germany [An ethical evaluation with visual presentation] Çağatay Üstün Ege Üniv Tıp Fak Tıp Tarihi ve Etik ABD e-mail: [email protected] Terminal dönem hastası olarak kabul edilen kavram, yaşamının son günlerinde ve ölmek üzere olan hastaya karşılık gelmektedir. Bu grup hastaların hastalıkları nedeniyle acı, ıstırap ve ağrı içinde olması, fiziksel ve mental yeteneklerini yitirmesi sonucu bakıma muhtaç bir hale gelmesi söz konusudur. Bu nedenle bir ihtiyaç şeklinde ortaya çıkmış bulunan hospiz sistemi, terminal dönem hastalarının yaşam kalitesini yükselterek, kalan yaşamlarını kendi doğal süreci içinde rahat, huzurlu bir şekilde geçirmesini sağlamaya yardımcı olan özel kurumsal yapılardır. Hospizlerde verilen palyatif bakım hastanın son dönem içinde yaşayabileceği fiziksel, psikolojik sıkıntıları azaltmayı hedeflemektedir. Hospiz sistemi özellikle ötanaziyi destekleyen düşüncelere karşı önemli bir alternatife işaret etmektedir. Sonuç olarak ülkelerdeki sağlık otoritelerinin terminal hastalar açısından hospizleri desteklemeleri ve teşvik edici çalışmalar yapması gerekmektedir. Organizasyon anlamında Avrupa’da gelişmiş hospiz örneklerinin Almanya’da olduğu bilinmektedir. Özellikle bir eyalet başkenti olması ve farklı sosyokültürel yapıdaki insanların yaşaması açısından Berlin’de bulunan hospizler bu konuda önemli bir yere sahiptir. Bu sunumda 13-22 Ağustos 2014 tarihleri arasında Berlin’e (Almanya) yapmış olduğum bazı hospizlere ve ortak yaşam evlerine yönelik akademik bir ziyaret ve gözlem çalışmasının içeriğini görsel materyal eşliğinde sizlerle paylaşacağım. The concept of terminal patient stands for a patient who leads the last days of his/her life and is about to die. The patients in this group are in grief, suffering and pain due to their diseases and have become in need of care because they have lost their physical and mental abilities. The hospice system, which came into being to meet this need, consists of special institutional structures helping terminal patients improve their quality of life and spend the rest of their lives in comfort and peace within its natural process. The palliative care provided in hospices aims at reducing the physical and psychological adversities the patients may experience in their terminal periods. The hospice system points to an important alternative especially to the opinions defending euthanasia. In conclusion, national health authorities should support hospices for the sake of terminal patients and carry out works to promote them. Germany is known to have organizationally developed hospice examples in Europe. The hospices in Berlin has a special place in this context as Berlin is a state capital in which people of different socio-cultural structures live. In this presentation, I will share with you, together with some visual material, the details of an academic and observational visit I paid to some hospices and common living homes in Berlin between 13 and 22 August 2014. Ethics is a discipline that deals with principles and standards of human conduct or moral values that govern relationships between and among individuals. Ethical conduct and professionalism are the cornerstones of medical practice for all physicians, including orthopedic surgeons. Concerns about patient welfare and physicians' behavior have been overriding throughout the history of medicine, originating with the code of Hammurabi, 4000 years ago. The primary aim of all doctors should be to care for patients to the best of their ability. In the field of orthopedics and traumatology, medical ethics continues to be discussed in different contexts. Orthopaedic surgical relationships with patients and colleagues should be based on honesty and transparency. Our patients be worthy of our compassion and understanding ,they need to choose between any treatments we offer, and it is our professional responsibility to explain options honestly and transparently, simply and clearly. Informed consent is now a mandatory part of everyday clinical practice especially when an operation is involved. Such consent has medico-legal implications, but even more importantly, it demands our ethical concern. Next to them, the orthopaedic surgeons have a responsibility for teaching and training. As teachers and trainers in orthopaedics, we carry a burden of responsibility to ensure that future surgeons develop both requisite knowledge and the ethical standards needed to look after patients with skill and care. Research and publication is another ethical interests. Orthopedic research should be based on ethical rules. There should be an end to the haphazard way in which new surgical techniques and products are introduced. Another issue that needs to be addressed is advertising. A physician should “not invite attention to himself or to his professional position, skill, qualification, achievements, attainments, specialities, appointments, associations, affiliations or honours and/or of such character as would ordinarily result in his self-aggrandizement”. Bu kanunla gelen uzmanlıklar içinde en önemlisi ise “Klinik Eczacılık”tır. Yirminci yüzyılın ikinci yarısında gelişen ilaç endüstrisi eczacının geleneksel işlevlerini değiştirmiştir. 1980’lerde öncellikle ABD’deki eczacılık otoriteleri, eczacının hasta tedavisinde daha etkin bir rol alması gerektiği görüşünden yola çıkarak, eczacılık mesleğine yeni sorumluluklar kazandıran “klinik eczacılık” kavramını ortaya atmışlardır. Sonraki yıllarda başka ülkeler tarafından da benimsenen klinik eczacılık uygulamaları yaygınlaşmaya başlamıştır. Ülkemiz için çok yeni olan bu kavram, etik tartışmaları da beraberinde gündemimize sokmuştur. Özellikle bu kavramla ilk defa karşılaşan hekimlerin, klinik eczacının görevleri ve önemi hakkında bilgi sahibi olmamalarından kaynaklanan yetki kargaşası ve “hekimin reçetesine müdahale mi edilecek” endişeleri tartışmayı önümüzdeki günlerde daha da ön plana çıkartacak gibi görünüyor. Bu çalışmamızda hekimlerin klinik eczacılığa bakışları ve yaşanması muhtemel etik tartışmalar konu edilecektir. “Specialisation on Pharmacy” had a legal ground through an article added to 6/11/2014 desicion dated and 6197 numbered Pharmacists and Pharmacies Law. The most significant specialisation among the ones mentioned in that law is Clinical Pharmacy. Pharmaceutical industry which developed at second part of 20th Century has changed the pharmacist’s traditional functions. At1980s, US pharmacy authorities had come up with “Clinical Pharmacy” concept which laid new burdens on pharmaceutical professions, based on the idea that the pharmacist must have a more active role in patient’s treatment. In the later years, clinical pharmacy was adopted by other countries and became widespread. As a brand new concept for Turkey, “Clinical Pharmacy” brought ethical problems along. It seems that this discussion will come into prominence in consequence of the doctor’s being newly encountered with this concept, not being aware of its importance, not being informed of clinical pharmacist’s duties and being worried about pharmacist’s supposed intervention on doctor’s prescription. In this study the doctor’s outlook on clinical pharmacy and probable ethical discussions will be entreated. Bu konuların başında cerrahi branşlarda uzmanlık eğitimi, yeni cerrahi tekniklerin araştırılması ve ve cerrahi bakım sorunları gelmektedir. Bu bildiri kapsamında, cerrahi ve etik ilişkisi bağlamında cerrahı dallara özgü etik sorunlar ele alınacaktır. In addition to the common ethical issues of their medical profession, surgical disciplines contain some ethical issues unique to these branches. At the beginning of this topic comes residency training in surgery the investigation of new surgical techniques and surgical care problems. In this presentation, ethical issues in surgery will be discussed.
